Utah sues Kalshi: prediction markets, gambling bans, and research alternatives

By Full Spectrum Sports Intelligence ·

Utah Attorney General Derek Brown filed a civil lawsuit against Kalshi alleging its event contracts are illegal gambling under the Utah Constitution. Full Spectrum Sports Intelligence is a research desk only — no wagers, no prediction market.

What the state is seeking

Federal context

Kalshi maintains it is a federally regulated exchange overseen by the Commodity Futures Trading Commission (CFTC) and that state gambling laws cannot veto federal jurisdiction. In February 2026, Kalshi sued Utah officials arguing the Commodity Exchange Act preempts state law. In August 2026, U.S. District Judge Robert Shelby granted summary judgment to Utah, holding that federal commodities law does not override Utah's gambling ban. Kalshi appealed to the 10th Circuit, which on September 8 denied a stay of enforcement pending appeal. That appeal remains pending.

The October state lawsuit follows that federal ruling and alleges continued activity in Utah after the decision.

Research, not a market

Full Spectrum Sports Intelligence is a research and analytics desk. It grades games, filters player props, and publishes signals. It does not accept wagers, offer event contracts, or operate a prediction market. Utah users looking for sports intelligence without placing a bet can use the desk and its research feeds.

This page is a research resource on the Utah action and the broader prediction-market debate. It is not legal advice and does not take a position on the outcome of the case.
