A license to read. Not a wager.

The operator of the Full Spectrum Sports Intelligence desk is “we.” The person who opens the desk or buys a Key is “you.” If you open the desk for a company, you bind that company, and you represent that you have authority to do so.

“Desk” means the live NFL interface, including scores, the map, weather, cameras, and news links. “Grade” means our reading of a game. “Key” means a paid, time-limited license to view the Grade on the games that Key covers. “Game Day” means a calendar day, measured in Eastern Time, on which the National Football League schedule lists a game. “Feed” means the machine-readable copy of the board.

Headings are for convenience. They do not change the meaning of a section. By using the Desk you accept these terms. If you do not accept them, do not use the Desk and do not buy a Key.

The Desk may be opened without charge. A Key is a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to view the Grade for the games and the period that Key covers. The license is personal. It is not a sale of the Desk, the Grade, or the software.

We reserve all rights not expressly granted. A Key may not be sold or transferred. The Desk and the Grade remain ours. Title stays with us.

A day Key returns only the games it covers. A game that Key does not cover is not in that Feed. Access ends when the Key expires. A fee is consideration for that period. It is not stored value, and it is not a balance you may cash out.

You may not copy, scrape, republish, resell, sublicense, or transmit the Desk, the Grade, or the Feed, except for your own personal reading of what your Key covers. You may not share a Key or a credential. You may not alter, decompile, or disassemble the Desk, and you may not attempt to derive the methods by which a Grade is produced, or build from the Feed a product that competes with the Desk. A breach ends the Key. Fees already paid are forfeited to the extent the law allows.

On each refresh, and again at intervals of about five minutes while the Desk is open, we may display an offer for a Key. You may dismiss the offer. Dismissal lasts only until the next refresh or the next interval. The offer is an invitation to buy a license. It is not a term of any wager, and it creates no duty to buy.

If you select Phone and grant notification permission, the same offer may be delivered to this browser while the site is open. Delivery occurs only after you grant that permission. We do not send the offer by text message. We do not collect a telephone number for it. We do not sell the offer. You may withdraw permission in the browser at any time.

A Key is a license to read information. It is not a wager, not a deposit with a sportsbook, not a tip, and not a promise that a Grade will win. We do not accept, hold, transmit, or settle a bet. We are not a sportsbook, a sports betting operator, a broker-dealer, or an investment adviser. No fiduciary duty, advisory relationship, or partnership arises from these terms or from your use of the Desk.

Nothing on the Desk is legal advice, tax advice, insurance advice, or investment advice. We are not registered as a broker-dealer or an investment adviser with the U.S. Securities and Exchange Commission, FINRA, or any state securities authority. Nothing here is an offer to sell a security or a recommendation of one. If you use a Grade as a reason to risk money, that risk is yours. You may lose some or all of what you put at risk. It should not be assumed that a Grade will be profitable, or that it will not be followed by a loss. Consult your own counsel or other licensed professional about your own situation. You bear the duty to check what you read. A score, a headline, or a camera can be delayed or wrong.

You alone decide what to do with what you read. You are responsible for compliance with the law of the place where you are, including any law that restricts wagering. You will not use the Desk for an unlawful purpose. A link to a sportsbook, a ticket seller, an airline, a hotel, or a casino is a link to that company. It is not an offer by us, it is not our endorsement, and it is not an offer into a state where that company may not operate. If a partner identifier is empty, the link is direct and we are not paid on it.

The Feed is part of the Desk. A program may read what these terms and the Key, if any, allow. The Feed is provided as is and as available. We do not promise uptime, latency, or that an endpoint will remain in its present form. The Feed may be delayed, incomplete, or wrong.

You may not redistribute the Feed or a Grade taken from it, and you may not use it to build a product that competes with the Desk. If we ever sign a separate writing with you about the Feed, that writing controls the access it covers. These terms control everything else.

The Desk, the Feed, and the Grade are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim every warranty, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. We do not warrant that the Desk will be uninterrupted, that a Grade will be correct, or that a Grade will produce a profit or avoid a loss. Human error and machine error are both possible, including delay and loss of a reading.

To the fullest extent the law allows, we are not liable for lost profits, lost data, or any indirect, incidental, special, consequential, or punitive damages, whether arising in contract, tort, or otherwise, even if we have been advised of the possibility. If we are liable in connection with a Key, that liability is limited to the amount you paid us for that Key. If you paid nothing, your remedy is to stop using the Desk. Some places do not allow a limit of this kind. In those places, the limit applies to the extent the law allows.

These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. The federal and state courts located in Utah are the exclusive forum for a dispute, and you consent to personal jurisdiction there. A dispute about the Desk and a dispute about a Key are not the same claim. Each may be brought on its own. Neither has to be joined with the other. We do not require arbitration.

These terms are the entire agreement between you and us about the Desk and about a Key. They replace any earlier statement about the same subject. If a court holds a provision unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms. We may assign the Desk and the Keys together or apart. There are no third-party beneficiaries.
